Q: My daughter is 8 years old, 52 inches tall and 64 lbs, is she too big for this?

Yes. I think so. I got it for our 4 year old last year and she is 55 pounds now and it seems to struggle with her weight. Her brother rides it some. He's 8 and only weighs 48 pounds, but he's getting too tall for it. For her age and size I would recommend something a little larger.

Q: What is the factory warranty ?

They would not warranty the one I had rear end stripped after a couple weeks of riding for a 40 pound child
