Q: Can this device program key fob for remote open/close of E46 convertible top?

Yes, I did it with my 2004 330ci. The range on my key isn't very far so it seems to lose connection at times while opening (you have to hold unlock for the duration of opening). Very cool feature!

Q: Can it program e36 keys?

I dont think so, i use it with E46 and i can program keys,

Q: Loaded the drivers, and got the message,"Hardware faulty" What next?

If you get Hardware Faulty when starting the BMW Scanner 1.4 then just plug it in the vehicle and start the app again. It should go away.
