would this work on a tub with an outside that is not perfectly flat? And if it does not work, is it returnable? Thank you

I don’t know their return policy. The device actually works with the white screw clamp facing inside the tub. This leaves the skid proof steel plate that you see pictured is what goes on the outside of the tub. Ours fit an older tub that the top 2 inches down was curved. It depends if you can get a grip with it about 4 or 5 inches down from the top. If you can, it will grip real tight since it is steel and grips like a vise.

Is it polished stainless?

Is not polished stainless, it is a painted metal.

Can you use it pn a old clawfoot tub its cast iron
